Alta. barley farmers take appeal to Supreme Court

The Alberta Barley Commission is taking its constitutional challenge of the Canadian Wheat Board to the Supreme Court of Canada.

The application for appeal to the highest court will be filed soon, said a news release from the commission. The appellants included the barley commission, Western Barley Growers Association and 21 farmers.

At this level, the case revolves around the contention that the wheat board act does not apply generally to all farmers in Canada.

They will ask the Supreme Court to extend the application to allow farmers the choice of whether to associate with the board or not.

The case started nearly five years ago and the farmers’ challenge has been overturned by the federal court and federal court of appeal.
