The federal government and supporters of single desk grain marketing are going back to court.

The two sides will appear before the Federal Court of Appeal May 23 to determine whether an earlier court ruling on the legality of Bill C-18 should stand.

Late last year, Federal Court justice Douglas Campbell ruled that Parliament acted unlawfully when it changed the Canadian Wheat Board Act. Campbell’s ruling suggested that Ottawa’s attempts to amend the CWB Act without adequately consulting farmers were “an affront to the rule of law.”

Ottawa announced later that it would appeal Campbell’s ruling.

The appeal will be heard May 23.

The appeal hearing is one of several legal actions involving legislation that will lead to elimination of single desk grain marketing Aug. 1.
