WINNIPEG (Staff) – The trial of a Manitoba farmer charged with exporting cereal grains to the U.S. without a Canadian Wheat Board permit continued here last week.
Provincial court judge Arnold Conner heard a request by the crown to allow testimony from three university law professors.
In his defence, David Sawatsky and his representative Dan Creighton have suggested the translation from French of section 95 of the Canadian Customs Act allows the export of grain without the CWB permit.
The crown is hoping to use interpretations of that law provided by the professors to fight the Sawatsky defence.
Conner was expected to decide whether to accept the crown witnesses on Jan. 24. No decision was available at press time.
