Three level of service complaints filed since August

The Canadian Transportation Agency has received three levels of service complaints since August 2013.

Louis Dreyfus Commodities filed a level of service complaint again Canadian National Railway. No details of the complaint were released by the CTA because of the “confidential contract they have with CN,” wrote the CTA in an email about the complaints.

“LDC has requested that the agency require CN to abide by contractual terms,” said the email.

The Canadian Canola Growers Association filed a complaint again CN and Canadian Pacific Railway, saying both railways did not fulfill their common carrier obligations in the current crop year.

Ashland Inc. and Ashland Canada filed a level of service complaint against CN requiring CN and Kelowna Pacific Railway to fulfill their respective level of serve obligations for the receiving, carrying and delivering of rail cars to and from Ashland’s facility in Kelowna.

Since the filing of the complaint, KPR’s Certificate of Fitness has been cancelled and KPR is no longer a federally regulated railway company.

Both Louis Dreyfus and the Canadian Canola Growers Association cited Sections 113 and 114 of the Canada Transportation Act requiring the railways to fulfill their common carrier obligations of the act.
