Ottawa appeals gag decision

The federal government is appealing a court decision handed down in June that lifted a gag order imposed on the Canadian Wheat Board in 2006.

The gag order had prevented the grain marketing agency from making any public comments in the debate over the future of the CWB single desk marketing system.

The case was brought by the CWB.

Judge Roger Hughes rejected arguments by government lawyers that the order was simply a spending restriction and that the government has the authority to direct and control the actions of the board.

In a seven-page document filed with the Federal Court of Appeal Sept. 18, government lawyers said Hughes erred in virtually every aspect of his decision.

The CWB will file a response to the government brief, and the case will eventually be heard by a panel of Federal Court judges.
