- You will be notified if the item you bid on did not exceed the reserve.
- Winning bid notifications will be sent out via email. This email will replace the winning bid certificates. Allow up to 48 hours after payment before contacting the participating vendor(s) about your winning item(s).
- Only items that meet the reserve price will sell on the auction. Status of reserve bid will be displayed on the item.

OFFICIAL AUCTION RULES
Western Producer Publications Limited Partnership (“The Western Producer”) and Glacier FarmMedia Limited Partnership (together, the “Auction Team”)
Your bid on an item indicates you will purchase that item WHETHER OR NOT YOU MEET THE RESERVE PRICE and that you intend to be the high bidder at the close of the Auction. We STRONGLY URGE you to visit or contact the participating businesses to view or find out more about items on which you intend to bid. All Auction sales are final.
- By participating in the Auction (including by registering and placing a bid), you acknowledge that you have read, understand and accept these rules. The Auction Team reserves the right to change these rules at any time and from time to time. If the rules or item descriptions and prices in the Auction guide or any other publication are different from those published on the Auction website, the latest rules found on the Auction website will apply.
- The Auction Team is only involved in administering the Auction, publishing certain item information provided by the sellers of items, and collecting the total purchase price for items. The Auction Team is not involved in buying, selling, exchanging, dealing or shipping of items, nor is it soliciting orders on behalf of the sellers. The Auction Team charges no listing fee to sellers, nor a fee to bidders or buyers.
- The Auction Team makes no representations or warranties any kind, expressed or implied, statutory or otherwise, with respect to the goods and services offered through Auction, including without limitation any: – representations as to quality, condition, functionality or features; or – implied warranties of merchant-ability, fitness for a particular purpose, title and non-infringement; or – any implied warranty arising from course of dealing or usage of trade.
- The Auction Team requires its sellers to confirm that all items in the Auction are new, and come with applicable warranties determined by the seller. The Auction Team does not take possession of the items during the Auction or otherwise, and assumes no responsibility for the items in any respect. The respective sellers of each item are solely responsible for shipping (the cost of shipping is included only where indicated) and providing the items as described in the Auction, including any condition qualifications, estimates, authenticity, title, representations as to the retail price including GST, and all other matters relating to the offer and sale of the items, and The Auction Team shall not be responsible for any difference in description, quality, value or condition between the item listed at the Auction and the item actually delivered.
- Bidders are encouraged to view and research items on which they intend to bid. All items are sold on an “as is” basis, which assumes that the Bidder is aware of what he/she is purchasing. Bidders can reach out to sellers participating in the Auction to ask questions about the products they have listed.
- Participation in the Auction is open to anyone 18 years of age or over, resident in Canada, except that a seller and its agents, servants, employees and their immediate family members cannot bid on items provided by such seller.
- Neither The Auction Team nor any of their respective employees, directors, officers or agents is responsible for the cost of or any claims relating to the item, including without limitation the use of any goods, the provision of services, or otherwise as a result of your participation in the Auction.
- You are prohibited from using any method, mechanism, device or software to affect the proper and fair functioning of the Auction and its website. The Auction Team may, at its sole discretion and without notice, terminate your right to participate in the Auction and nullify any bids you have placed.
- All content on this website is the property of The Western Producer or the sellers. Any use by a user other than participation in the Auction (lawfully and in accordance with these Rules), including reproduction, modification, distribution, transmission, or display of the content on the website is strictly prohibited. The Auction is not responsible for the availability or content of any other website to which the auction website is linked.
- The Auction is governed by and construed in accordance with the laws of Saskatchewan. You agree to comply with all applicable laws, statutes and regulations regarding participation in Auction and use of the website.
BIDDING RULES
- The Action commences on November 13th at 9:00 am (CST) and ends November 24th at 9:00 pm (CST) (the “Auction Term”). Starting and ending time of the Auction Term is determined by the website clock. Bids will be accepted during the Auction Term only. Users of the website clock must refresh the web page by clicking the browsers “refresh button” to obtain an accurate time and current bid, and are STRONGLY URGED to do so prior to checking or placing a bid, especially in the last hours of the auction. The Auction Team reserves the right, at its sole discretion and without notice, to extend, terminate or modify the terms or duration of the Auction in the event of unforeseen technical difficulties, local events, or world events, that alter the proper functioning of Auction.
- Bids may be placed online 24 hours per day during the Auction Term at the Auction website, www.producerauction.com. You must register to be an active bidder in the Auction. No telephone bids are accepted for this Auction.
- The Auction Team will form a “Bidder Trust Committee”, comprised of two or more individuals who will determine certain matters pursuant to the Auction. The Bidder Trust Committee will set a starting bid and a minimum bid increment for each item. The starting bid is the minimum amount required to participate in the bidding for that item. All bid amounts must be in whole dollars (i.e. no cents) and must meet or exceed the set minimum bid increment posted for each auction item.
- Each item has a hidden minimum price, below which the item may not be accepted to be sold (a “Reserve Price”), which is set by The Auction Team. The Reserve Price for an item is usually between 60 per cent and 70 per cent of the ordinary retail selling price of the item. An Item will not be sold below its Reserve Price.
- The Auction has an auto-bid system. This allows the users to define their maximum bid which will display as the latest bid placed on that item. Choose your maximum bid carefully, as you will be legally bound to pay up to that price (plus any applicable taxes) if it is the final highest bid.
- It is your responsibility to monitor the outcome and status of your bids on the Auction website and, in the event that you are outbid by another bidder, it is your responsibility to determine whether you will continue bidding on an item. If you are outbid by another bidder, you must submit a new bid in order to continue your bidding on that item. If you submit a new bid, that bid supersedes all your previous bids on that item. The amount of the new bid must be at least one minimum bid increment higher than the current leading bid on the item. Under no circumstances will retraction of a bid be allowed. If you submit a bid against yourself, both bids will be considered valid, such that the higher bid will supersede the lower bid.
- If two or more bidders bid the same amount on the same item, the bidder whose bid was placed first shall be considered the leading bidder.
- In the event of a dispute between bidders, or between bidders and the Bidder Trust Committee, or in the event of doubt or dispute as to the validity of any bid, the Bidder Trust Committee will have the discretion to determine the successful bidder. All decisions by the Bidder Trust Committee are final and binding and not subject to review or appeal.
- The Auction Team is not responsible for any bids that are lost, misdirected, incomplete or illegible, or for failed, partial or garbled computer transmissions, or for technical failures of any kind relating to the Auction, including, but not limited to, malfunctioning of any network, hardware or software, which may limit a bidder’s ability to participate in the Auction or cause delays or errors in bidding. Proof of sending will not be proof of receipt by the Auction. The Auction is not responsible for any online, long distance telephone, or other charges you may incur in connection with participating in the Auction.
- During and after the Auction, you may receive email notifications, such as that another bidder has outbid you, or that you have made the highest eligible bid on the item (and are a “Winning Bidder” in respect of such item). These emails are for informational purposes only. Their transmission or omission does not constitute or guarantee any change in the status of your bid or those of other bidders. Only the record of bids in the Auction system, as represented on the Auction website, constitutes the true bid record, as used by the Bidder Trust Committee to determine the Winning Bidders at the close of the Auction.
PAYMENT RULES
- The Winning Bidder for each item will be contacted by email and/or phone within five business days following the end of the Auction Term to notify him/her of his/her winning status and request payment for unpaid winning items. Winning Bidders are obligated to make full payment of their highest bid price plus applicable taxes (the “total purchase price”) within five business days of notification. If a Winning Bidder cannot be contacted, or if payment is not received in full within five business days of contact first being initiated, the Bidder Trust Committee reserves the right, but is not obligated, to disqualify such bidder and offer the next-highest bidder (who will then become the Winning Bidder) the opportunity to purchase the item. If such offer is accepted, the next-highest bidder will be considered the Winning Bidder and shall be obligated to make full payment of such Winning Bidders total purchase price within two days of acceptance. The Bidder Trust Committee reserves the right to continue the process of disqualification and notification of subsequent bidders until payment is received, or to remove the item from sale. Complete payment and Proof of Winning Bid instructions will be sent out via email to the Winning Bidder following the end of the Auction Term. Winning Bid fulfillment methods may also be available depending on the item purchased.
- By agreeing to participate in this Auction, you agree that each and every bid placed is a legally binding offer to purchase the item at the price bid, whether the bid has met the Reserve Price or not, and whether the bid is the highest bid received or not.
- The Winning Bidder shall pay the total purchase price to The Western Producer within the time period set out in Section 21 above, provided that in the case of Automobiles, Real Estate and other high priced items, The Western Producer may accept a non-refundable deposit of 1 per cent to 5 per cent of the total purchase price pending arrangement of the winning Bidder’s financing, provided that the balance must be paid by such later date stipulated by the Bidder Trust Committee (regardless of whether financing can be obtained).
- It is the Winning Bidder’s responsibility to obtain any applicable or necessary licenses, registrations, or any other approvals required to lawfully own and/or operate the items purchased at the Auction, and to pay any fees associated therewith. Bidders may wish to consult with the seller of the item or perform other research to confirm whether any such licenses, registrations or approvals are required.
- Once full payment of the total purchase price has been received by The Western Producer, the Winning Bidder will receive a Winning Bid notification to be presented to and collected by the seller to release the item. All item delivery or pick-up arrangements must be made with the respective seller. Delivery, packaging and/or insurance may incur additional charges above and beyond the total purchase price, to be negotiated separately between the Winning Bidder and seller.
- If a Winning Bidder fails to comply with these rules – including the obligation to make full payment of the total purchase price within the time limits and terms set out herein – then in addition to other remedies available, The Auction Team or the seller may cancel the sale. Bidders will remain liable for any damages or losses caused by their default, including any amount by which a Bidder’s highest bid exceeds the price that the item is ultimately sold for.
- The Auction Team will charge and collect all applicable taxes (based on jurisdiction, use, etc.) from Winning Bidders and remit these collections to their respective government agencies, except in the cases of items such as Motorized Vehicles, Automobiles or Real Estate where the seller will collect applicable taxes. If you are the Winning Bidder on a vacation, you are responsible for all expenses not explicitly included such as airport taxes, ground transportation etc. and must have all documentation necessary for travel. Please note that in some jurisdictions, homes or vehicles carry special tax legislation that requires that tax be paid on Fair Market Value.
- As stated in these rules, all sales are final. However, in the event that an item you won and paid for was fundamentally misrepresented on the Auction website or contained a manufacturer’s defect, a refund may be considered by the Bidder Trust Committee. Refunds are not guaranteed. Please contact the Bidder Trust Committee at if you have received an item that was fundamentally misrepresented on the Auction website or contained a manufacturer’s defect.
Privacy
CONFIDENTIAL REGISTRATION
A full registration is required to actively place bids, including (without limitation) your full name, address, phone number(s) and e-mail address. This information will be used to contact you in the event that you are a winning bidder or for a payment toward an item after the Auction Term. You may receive a follow up offer or invitation on items that you have placed a bid on from the Auction Team on behalf of the participating seller. You will be assigned a unique User Name that allows you to place bids and follow their progress in the Auction. NOTE: This User Name may result in you being identified by others unless you select our anonymous bidding feature during the placement of your bid. The login and create a new account page information that is entered is transferred and stored on The Western Producer’s encrypted server.
PURPOSE OF CONFIDENTIAL DATA
All information collected is for the sole use of The Western Producer and the sellers in connection with the Auction. This information will not be communicated to any other third parties without your consent.
